Yes, Online Dispute Resolution (ODR) outcomes are fully binding and legally enforceable in India. Mediation settlements (MSAs) are enforceable under the Mediation Act, 2023. Arbitration awards are final and binding under Section 36 of the Arbitration and Conciliation Act, 1996, carrying the same force as a civil court decree.
The ODR process starts by filing a case details form and uploading supporting documents on our platform. Once filed, our system automatically reaches out to the opposing party via email, SMS, and WhatsApp with formal, verified notifications to invite them to the secure online resolution workspace.
If the other party refuses to join, voluntary mediation/negotiation stops, but arbitration can proceed in their absence (ex-parte). In voluntary paths, we issue a formal 'Non-Starter Certificate' as proof of your good-faith attempt. If you have a valid arbitration clause in your agreement, the arbitration process can proceed legally under the law.
