What is Legal Metrology

The law behind every weight, measure and label

"Metrology" is the science of measurement. The Legal Metrology Act, 2009 governs how weights, measures and measuring instruments are used in trade, and how pre-packaged commodities must be labelled — bringing transparency to commerce and protecting consumers from inaccurate measurement and misleading packs.

The Act is administered by the Department of Consumer Affairs at the centre and by the Controller of Legal Metrology in each state. Depending on your activity, you may need a dealer or manufacturer license from the state Controller, or an LMPC registration as a packer or importer of pre-packaged goods.

Why You Must Register

Non-compliance carries real penalties

Under the Legal Metrology (Packaged Commodities) Rules, 2011, registration of manufacturers, packers and importers is mandatory before conducting business. Importers must apply ahead of their first import, and packers/manufacturers generally within 90 days of starting pre-packaging.

  • Every pre-packaged commodity must carry mandatory declarations — name and address of the manufacturer/packer/importer, country of origin, net quantity, MRP, and date of manufacture/packing
  • Customs can hold imported goods at clearance if the LMPC certificate isn't in place beforehand
  • Breach of the packaging rules attracts statutory fines, and in the case of a company, individual officers can be held liable

A license is not transferable or saleable and must be displayed prominently at the place of business. If packaged goods are sold in more than one state, registration requirements can extend across those states.
